But wait, there’s more. Even if you take the offer you still have lots of languishing. The file has to be marked with the plea bargain and you, along with everyone else who made a deal, is herded back down to the courtroom. The files are placed to the side of the judge, who you must formally go before to have your rights explained to you, allocute the plea, and be sentenced. If there was nothing else going on to do 50 or so of these allocutions could easily take an hour. But there are things going on – lots of things. The court could be doing arraignments, conferencing civil matters, or taking oral arguments on a motion. Eventually, when there is a lull in the activity, they will call the traffic tickets for formal plea and sentencing. This may occur in the late morning or afternoon.
And if you decide to take your case to trial the pain train continues. You DON’T get a trial that day. Instead, the matter is adjourned to another day for trial. This is done around not your schedule, but the police officer’s schedule, of which the town attorney has absolutely no idea at that time when the officer will be working a day shift on a Wednesday. So you are told that you will be notified by mail of the trial date that is unilaterally set by the court contingent upon the police officer’s availability with no input from you or consideration of your schedule. This likely means a second day you need to take off from work.
On this second day you again have to be there at 9:30 a.m. However, the traffic ticket trials are the LAST THING done. The trial usually takes place mid to late afternoon. So why show up at 9:30 a.m.? Because there are days when the calendar is short and if they call your case and you’re not there the matter will be marked defaulted and your driving privileges will be suspended. This will cause you to have to go to court, post a bond, pay a fee to clear your suspension, and then have to go through this fire drill A THIRD TIME.
