SUFFOLK COUNTY TRAFFIC TICKETS, SPEEDING TICKETS, AND MOVING VIOLATIONS

If you are issued a ticket for a moving traffic violation or speeding ticket in the Town of Babylon (including the villages of Amityville, Babylon Village, and Lindenhurst) in Suffolk County, New York you will not be brought before a court of law but rather before the New York State Department of Motor Vehicles (DMV) Traffic Violations Bureau (TVB).

This means that your case will not be heard by in a real court by a real judge, but by a department of motor vehicles Administrative Law Judge (ALJ). The same is true if your Suffolk County ticket was written in the Town of Brookhaven, New York (including the villages of Belle Terre, Bellport, Lake Grove, Old Field, Patchogue, Poquott, Port Jefferson, and Shoreham).

Likewise, if you are accused of speeding, running a red light or another moving violation in the Town of Huntington, New York (including the Village of Huntington, Village of Asharoken, Lloyd Village and the Village of Northport) you will also be brought before the DMV court. There are serious implications to having your ticket adjudicated administratively instead of judicially. When before the TVB your attorney has no ability to obtain pre-trial disclosure. Unlike in a court of law, your lawyer has no right to obtain a supporting deposition.

The Traffic Violations Bureau also handles the stop sign and moving violations that are issued in the Town of Islip, New York (Including Islandia, Brightwaters, Ocean Beach and Saltaire). The ability for your law firm to make pre-trial motions to dismiss or to qualify the police officer as having minimum training and experience and expertise in the radar or laser for speeding ticket violations is likewise limited if the ticket was written in the Town of Smithtown in Suffolk County (including the Village of Head of the harbor and Village of the Branch), as that town also uses the TVB.

Unlike in a regular court of law, the TVB has a strict policy that prohibits the right to plea bargain. This means that every moving violation issued in the towns of Babylon, Brookhaven, Huntington, Islip, and Smithtown in Suffolk County, New York will go to trial. Further, the burden of proof is not “beyond a reasonable doubt” as in a regular court but the mere burden of “clear and convincing evidence.”

This requires that you hire an attorney experienced in the Vehicle and Traffic Law trials. The lawyers here regularly appear in the TVB courts and conduct moving violation and speeding ticket trials. Our lawyers understand the elements of a violation and know how to cross-examine the police officers to put you in the best possible position to beat the ticket. You have everything to lose by pleading guilty as charged and failing to assert your right to a trial. Moving violation points can cause your insurance premiums to skyrocket. Accruing more than 10 points in an 18 month period results in a license suspension. This is why it is so important to fight your traffic ticket in Suffolk County.

Best yet, by hiring our law firm, you NEVER have take off time from work, testify, or appear in court. Our attorneys handle the entire transaction, from the initial plea of “not guilty” through any adjournments to final resolution. If you are found guilty our lawyers obtain time for you to pay and forward detailed payment instructions. Call today!
