Moving Violations and Traffic Tickets
If you are issued a moving violation, such as a speeding ticket, improper turn, or running a red light in the Town of East Hampton (including the villages of East Hampton and Sag Harbor) you will not be brought before the New York State Department of Motor Vehicles (DMV) Traffic Violations Bureau (TVB). Rather, you will be before the Town of East Hampton court.
Unlike the DMV an attorney can do more in defending you against a speeding or moving violation ticket. Before a regular court a lawyer can (1) demand supporting depositions, and (2) when appropriate move to dismiss the ticket or move for pre-trial hearings.
In the Town of Riverhead and Town of Shelter Island a charge of following too close or other moving violation is likewise brought before a court of law. Unlike in the DMV, there is no policy prohibiting plea bargaining before trial. This is an effective way for your law firm to reduce or eliminate the points without the need to risk being found guilty as charged.
In the Town of Southold and its village of Greenport the local justice court adjudicates the matter. In these courts, the burden of proof is that of “beyond a reasonable doubt,” not the lower standard of “clear and convincing evidence” as before the he New York State Traffic Violations Bureau.
Even though the Village of Quoque and Village of Westhampton Beach are in the Town of Southampton, each jurisdiction has its own court. Therefore, each village and the town handles their own tickets separately. Because of this, there is an inconsistency between how the same violation is handled in the different courts.
Indeed, each of the above courts differ in the manner in which the ticket is handled, the hours of operation, fines and sentencing and the policies as to adjournment. This is why you need to hire the experience of our law firm to represent you before any of these courts when you receive a traffic ticket. Moving violation points can quickly add up, and once you accrue 11 or more your license is automatically suspended. Best of all, by hiring out lawyers you never have to appear in court.
